Chapter 16.38 RA-1 RESIDENTIAL--AGRICULTURAL
Section 16.38.020 Permitted uses.
The following buildings,
structures and uses of land
shall be permitted in the RA-1 zone upon compliance with
requirements as set forth in
this title:
A. Any use permitted in
the R-1 residential zone;
B. The raising, care and
keeping of animals and fowl
in limited numbers as
follows; two (2) hogs or two
(2) cows or two (2) horses,
or two (2) llamas, or two (2)
emus, or two (2) ostriches or
five (5) sheep and their
suckling offspring or twenty-five (25) fowl or
combination thereof, may be
kept for each twenty
thousand (20,000) square
feet of lot area; and further
provided that no animal shall
be kept on lots containing
less than twenty thousand
(20,000) square feet and
provided that the maximum
number of animals which
may be kept on any one (1)
lot or parcel of land shall not
be more than ten (10) hogs or
ten (10) cattle or (10) horses
or ten (10) llamas, or ten (10)
emus, or ten (10) ostriches or
twenty (20) sheep and their
suckling offspring or fifty
(50) fowl or combination
thereof;
C. Machinery sheds for
the storage of farm
machinery, farm produce
sheds, buildings and cellars;
D. Barns, corrals, pens,
coops and feed storage
buildings for the keeping of
animals and fowl and the
storage of farm products,
provided uses for the care
and keeping of livestock and
fowl are located at least one
hundred (100) feet distance
from any existing dwelling,
public or private buildings
used for occupancy;
E. Day-care nurseries
which have been approved
by the State Health and
Welfare Department;
F. Clubs, lodges, except
those in which the chief
activity is a business;
G. Rest homes;
H. Residential facilities
for the elderly for (8) or less
individuals, owned by one
(1) of the individuals or an
immediate family member of
one (1) of the individuals
residing at the facility or for
which the title has been
placed in trust for a resident,
that also complies with the
following:
1. The facility conforms
to all applicable health,
safety and building codes,
2. The facility is capable
of use as a residential facility
for elderly persons without
structural or landscaping
alterations that would change
the structure's residential
nature,
3. No other residential
facility for elderly persons
shall be established within
three-quarters (3/4) of a mile
of another existing
residential facility for elderly
persons or residential facility
for handicapped persons;
I. Residential facilities
for the handicapped for eight
(8) or less individuals under
the supervision of a house
family or manager on a
twenty-four (24) hour per
day basis and complying
with Department of Human
Services standards and
requirements and be operated
by or operated under contract
with that department, that
also complies with the
following:
1. No person being
treated for alcoholism or
drug abuse shall be placed in
a residential facility for
handicapped persons,
2. No person who is
violent shall be placed in a
residential facility for
handicapped persons,
3. Placement in a
residential facility for
handicapped persons shall be
on a strictly voluntary basis
and shall not be a part of, or
in lieu of confinement,
rehabilitation or treatment in
a correctional institution,
4. The facility shall
conform to all applicable
health, safety and building
codes,
5. The facility is capable
of use as a residential facility
for handicapped persons
without structural or
landscaping alterations that
would change the structure's
residential nature,
6. No other residential
facility for handicapped
persons shall be established
within three-quarters (3/4) of
a mile of another existing
residential facility for elderly
persons or residential facility
for handicapped persons,
7. That the operator of
the facility shall establish a
City advisory committee
through which all complaints
and concerns of neighbors
shall be initially addressed,
8. The operator of the
facility shall provide
adequate off-street parking;
J. Other uses ruled by
the Planning Commission to
be similar to uses specifically
permitted in the zone and
which will harmonize with
the objective and
characteristics of the RA-1
residential-agricultural zone.
K. Household pets not to
exceed a combination of four
(4) pets over the age of four
(4) months.
L. Low powered radio
service antennas as outlined
at Section 16.36.020. (PZSC
